Casey Bokhoven's father brought a civil suit against Tolly Carr and three bars that allegedly served him excessive alcohol. The suit was filed Friday, May 18, 2007.
The civil suit also outlines graphic details of Casey's last moments including a terrifying and conscious realization of the impending collision, excruciating pain and suffering in the moments after Tolly Carr hit Casey and as he was thrown or dragged 22 feet, after which the pickup truck landed on him and he died.
This was heartbreaking to read.
The civil suit alleges that Carr consumed around 17 drinks at three bars before getting into his pickup truck drunk, driving down West First Street without headlights on and ultimately killing Casey.
The three bars mentioned are: Sounds on Burke, 6th and Vine and the Burke Street Pub.
A figure of $10,000 is being requested however, it is ultimately up to a jury to decide the amount actually awarded. Arbitration will be used first to see if a figure can be agreed upon by the defense and the prosecution.
Casey Bokhoven, age 26, was violently struck and killed by a pickup truck as he stood on a sidewalk waiting for his girlfriend. The truck, driven by WXII (Winston-Salem, NC) morning anchor Tolly Carr,vaulted over a small wall and hit Casey at 30 mph, dragging him 22 feet, hitting a building and coming to rest with Casey under the wheel. The incident occurred Sunday, March 11, 2007 around 3:40 AM. Charged with DWI, Carr admitted he had been drinking and warrants detail that he refused a Breathalizer test. Blood was taken from Carr, and the results of blood-alcohol tests showed that Carr's blood alcohol concentration was .13, well over the legal limit of .08.
