In a series of judgments, the Supreme Court has underscored the rights of those accused of money laundering, despite the strict arrest and bail rules under the Prevention of Money Laundering Act, 2002 (PMLA). In the case of Vijay Madanlal Choudhary v. Union of India (2022), a bench of three judges led by retired Justice A M Khanwilkar upheld all the contested provisions of the PMLA, including the tough bail conditions and broad investigative and arrest powers granted to the Enforcement Directorate (ED).
