Traumatic brain injuries arising from a closed head injury, a serious concussion or series of concussions can result in a finding of disability by a Social Security judge. However, as I discuss in this video, it is no longer enough to come to court to present evidence of a head trauma.
Judges in Social Security disability claims are looking for long term impairment to your functioning. This can include cognitive (thinking and processing) problems, sensory deficits and emotional and behaviorial changes.
I have also found that judges expect to see specific types of evidence and treatment records from brain injury specialists. Evidence can also take the form of both medical records and statements from third parties describing odd behavior.
Traumatic brain injury disability claims are often winning cases, but proper case development with the right type of evidence is essential.
