Professor of Public Law at the University of Cape Town, Richard Calland, says tension exists between the constitutional duty to the people by members of Parliament, and the reality of political punishment for dissidence. Testifying at the State Capture Commission of Inquiry earlier this week, Calland said what is needed from MPs is the ability to act independently and honour their oath of office in holding the executive to account.
Notably, Dikeledi Magadzi, the current Deputy Minister of Transport who previously chaired the Portfolio Committee on Transport told the Commission she always followed the instructions of the ANC that deployed her to Parliament.
Magadzi was referring to her decision not to support an opposition motion to set up an ad hoc committee to investigate allegations of corruption involving the Guptas at the Passenger Rail Agency of South Africa or PRASA.
