First up, attorney John Deaton, former SEC lawyer Marc Fagel, and pro-XRP lawyer Jeremy Hogan recently discussed the Hinman documents and the controversies surrounding them in a CryptoLaw live cast. Hogan speculated that Ripple believes Bill Hinman was paid by the Ethereum Foundation or someone related to Ethereum to give the speech that excluded Ethereum as a security asset. Hogan also pointed out factors used to exclude Ethereum as a security asset that could be baseless in a court of law, implying a potential attack on XRP and Ripple. In addition, Hogan noted that at the time of the speech, Ripple had immense control of XRP Ledger validators and held over half of the total 100 billion XRP that will ever exist. He concluded that Ripple was saying that the speech was an Ethereum free pass but also an attack on XRP, which was at the time ETH’s biggest competition.
