First of all, when you bring a civil lawsuit in New York seeking money as a form of compensation for the harm, damages and injuries you suffered, your life becomes an open book.
The defense attorney, the lawyer who represents the people you have sued, will have the chance to ask you many questions about your life, your background, your medical history as well as what problems you have today, among others.
You may be a private person.
You many not like sharing your medical details.
You may have a history that is less than perfect.
You don't want to disclose those things.
What happens if you REFUSE to answer certain questions?
Well, unlike in a criminal case at trial, you DO NOT have the right to refuse to answer questions.
There are two well known exceptions.
One is where the opposing lawyer asks you questions about confidential discussions with your attorney. The other is where you're asked an off-the-wall question, that lawyers call a 'palpably improper' question.
