In workers’ compensation, payment of benefits generally depends on claim status. The real question is whether the claim is accepted, denied, or on delay. If your claim is accepted, benefits (including temporary disability, permanent disability advances, and medical treatment) will be paid. If the claim is denied, none of those benefits will be paid. Your focus must be on getting the claim accepted, or proceeding to trial on AOE/COE. If the claim is on delay, then no TD or PDA’s will be paid, but medical treatment will be paid up to $10,000 while the claim is on delay. This video goes through a number of the variables and options that come into play.
