Did you know in a few states, you can be arrested for a DWI/DUI if you drink AFTER driving!? I know, it sounds crazy!
All the government has to do is prove that you were intoxicated when you gave a breath test, even if that's AFTER you had been driving. Thankfully, in many states, this is not the case. But, there are still some intricacies that could get you arrested for DWI.
If the cops show up already thinking someone is drunk and you are operating a vehicle, they will look for anything that gives them reasonable suspicion you are drunk, includinging field sobriety tests and portable breath tests. You have the legal right to say NO to these. This is why many lawyers will tell people to make the police get a warrant for their breath or blood. The longer it takes to get a warrant, the more time people have to sober up.
