Is it possible to get off Deferred Adjudication probation early? How do you do it?
Most criminal charges in Texas will allow you to qualify for an early release from deferred adjudication probation if you make sure certain requirements are met. Let’s cover them very quickly:
1. You must complete all your community service
2. You must have finished all your classes successfully
3. You must be up to date on your probation fines and court fees
4. You need to have been mostly successful in reporting to probation and staying on top of your probation.
5. You need to hire an attorney to file a motion for early termination/release of probation
Quick tip: Before you spend the money to hire an attorney to file a motion for early release, talk to your current PO and make sure they would recommend you for it. The firs thing that will happen after an attorney files the motion for early release, they will ask your current PO if they recommend it. If not, you could be dealing with an uphill battle.
Beware: Not all offenses qualify for an early release. Many sexual based offenses, DWI’s, domestic violence cases and cases involving violence against victims may not be eligible for this early release.
How long must you wait before you file? Texas law says you must wait until at least 1/3 of the probation is completed before you are eligible to file. Some judges in Tarrant County, Texas require you to complete half the probation before they will approve it so you need to make sure you speak to your lawyer about what strategically makes sense.
