Will your prenup hold up in court? 🤔
That's a loaded question. Let's break it down:
Vast majority or states, when you get divorced you either do it amicably or a litigated case (which is what you see on TV—trial, drama, etc).
The vast majority don't get to that point. It gets very expensive.
When you have a prenup and get a divorce, you can either follow the terms of the agreement, or, generally (each state is different) you can file in court and have a litigated case to come to a conclusion on whether or not your prenup should be "enforced" by the court.
It's about following the terms, or incorporating the terms in court.
In essence? This question is up to the court at the time of your divorce.
