Fremont officers on Thursday released audio and video from the department’s third police killing this year, the August 25th shooting death of 22-year-old Hayward resident Kevin Victor Johnston.

Officer Jesse Hartman shot and killed Johnston on the dirt median along Auto Mall Parkway near Southlake Common around 6:04 p.m. that Wednesday night.

Police said Johnston matched the description of a man who shot and critically wounded another man in a mobile park about 45 minutes before Hartman shot and killed him.

Johnston also had a warrant out for his arrest for several felonies, including carjacking, being a felon in possession of a firearm, carrying a loaded firearm in public and possession of a controlled substance among others.

Officer Hartman only captured video from his in-car unit, but not audio because of what his Acting Police Captain called a bad microphone.

Hartman also did not activate his body worn camera as he arrived to the dirt median on Automall Parkway. The plainclothes officer approached in an unmarked vehicle, coming from another investigation in another city. He left his camera on its charging dock in the car.
