What Is A Frivolous Or Tax Protestor Filing?
The IRS has identified 46 positions as frivolous or tax protestor arguments in IRS Notice 2010-33. If a tax return presents one of those positions and seeks income exclusion, a deduction, or a credit based on such position, the IRS will use its authority under section 6702 to classify the tax return as frivolous. The IRS will then begin taking steps to impose a $5,000 penalty on that return submission.
