Iancu v. Brunetti | 139 S.Ct. 2294 (2019)
In the space of two years, the United States Supreme Court considered the constitutionality of two separate restrictions on the kind of trademarks that can be federally registered. The second of these cases was twenty nineteen’s Iancu versus Brunetti.
The U S Patent and Trademark Office administers the federal trademark registration system. Registration gives a trademark’s owner valuable benefits and some advantages in the event of trademark infringement litigation.
Erik Brunetti sought to register the letters F U C T as a trademark. Brunetti pronounced it as an initialism, with the letters sounded out. But pronounced as a single word, it sounds like fucked, considered a vulgar profanity.
The trademark examiner determined that Brunetti’s trademark was immoral or scandalous. The P T O’s Appeal Board agreed. The Federal Circuit reversed, then the Supreme Court granted the cert petition of P T O director Andrei Iancu.
