Richard Alan Eckhart was convicted of possession with intent to distribute marijuana and sentenced to ten years in prison with four years suspended. During a search of a residence, drugs and drug paraphernalia were found. Initially, none of the individuals admitted ownership of the drugs, but Mrs. Tucker later claimed ownership. Defendant did not admit ownership of any drugs, and none were found on his person. The only issue on appeal is whether the trial court erred in admitting hearsay testimony repeating the statement of Betty Jean Tucker.
