Mediation in a family law or divorce case would be first either court-ordered by the judge or the parties can agree to go to a mediation outside of a court order, but if so going to the mediation is not enforceable. When you go to mediation the parties would be present, the certified family law mediator would be present, and if a party is represented by an attorney, the attorney would also be present to give his or her client advice during the mediation. The mediator cannot give legal advice even if she or he is an attorney to either party whether the party came with an attorney or not.
