After a person’s been arrested and has their first appearance the next morning in Tampa Florida, Hillsborough County, the next court appearance is called the arraignment.
At the arraignment, the judge will ask whether or not charges have been filed. The state attorney will respond, “yes they’re filed / no they are not”.
In between the first appearance, the arraignment is when an attorney can help you. I’ve done this many, many times. I speak to the prosecutor, I speak to my client and the person that’s been arrested and we try to persuade them not to file charges - meaning the prosecutor - or file less serious charges, or fewer charges.
At the arraignment also the judge will ask “have you retained an attorney, sir - or do you want us to appoint a public defender?”
At that point, we’re on board, we file our notice. In most cases, the person charged doesn’t even have to appear for his arraignment if they’ve hire us. We do that for you, we take care of that for you - you don’t have to go to court.
And the importance of the arraignment is you know what the charges are, whether they’ve been filed or not. If the prosecutor is seeking a certain punishment or not, it’s usually known by the arraignment, and whether or not you even have to go to court at all.
