State v. Smith | 136 Vt. 520, 396 A.2d 126 (1978)

Richard Smith entered the apartment of a boy and his babysitter. Smith raped the babysitter and stabbed the boy to death. Smith was charged with rape and murder.
Smith had previously been treated for personality disorders. Accordingly, Smith asserted that he was not guilty by reason of insanity. The trial court admitted evidence regarding prior instances of Smith’s violent conduct. The trial court refused, however, to admit evidence that related those violent episodes to his alleged mental disease or defect. The trial court also declined to admit lay-witness testimony regarding Smith’s mental condition.
In addition to asserting insanity, Smith asked the trial court to charge the jury on diminished capacity. The trial court denied Smith’s request. Smith was convicted of rape and murder. Smith appealed to the Vermont Supreme Court.
