New York Landlords need to know the New York Landlord laws and New York State Residential Lease Laws when managing their rentals. The Lease Agreement is the foundation of the Landlord-Tenant relationship. It outlines key terms and rules and is what protects both parties if issues arise. A standard, fixed-term Lease is usually for a one-year (12 months) term that ends at the end of the Lease period.
Either party can terminate a New York month-to-month Lease Agreement with 30 days’ notice if the Tenant has been in the unit for less than a year; 60 days' notice if the Tenant has been in the rental between 1 and 2 years; and 90 days notice if the Tenant has lived in the unit for more than 2 years. Rent-stabilized apartments have more strict notice requirements, so it’s important to check notice requirements before ending a Lease.
New York State Lease Laws & Requirements
New York Landlords must provide Tenants with a disclosure about whether or not there is a sprinkler system used for fire safety.
Landlords must disclose whether the property is in a flood plain or if the property has a history of flooding. NY Leases must also include specific language about flood insurance.
Landlords of rent-controlled properties must provide Tenants with an executed copy of the Lease Agreement within 30 days of the start of the Tenancy.
Finally, if the rental unit was built before 1978, landlords must provide tenants with a lead-based paint disclosure form and pamphlet. This form must inform tenants about the potential dangers of lead-based paint and any known lead-based paint hazards in the rental unit.

Now, let’s talk about some key New York State Landlord Tenant Laws.
New York Security Deposit Regulations
Security deposits may not exceed one month’s rent, and Landlords must disclose the name and address of the financial institution where the deposit is being held. At the end of the Tenancy, the security deposit must be returned within 14 days of the end of the tenancy, along with an itemized list of deductions.
New York Landlord Entry Laws
When it comes to notice to enter, Landlords must provide tenants with reasonable notice before entering the rental unit for non-emergencies. 24 hours’ written notice is generally considered reasonable.
New York Late Fee Requirements
Late fees cannot be charged unless rent is at least 5 days late. Late fees cannot exceed $50 or 5% of the rent due, whichever is less.
Renters Insurance in New York
Landlords of rent-controlled apartments may not require Tenants to get renters insurance.
New York Returned Check Fees
Returned payment fees in New York may not exceed $20, and this fee should be discussed in the Lease Agreement.
New York Increase in Rent Laws
New York Landlords must provide Tenants with written notice of rent increases. Additionally, several municipalities in the state have rent control laws limiting the amount that Landlords can increase rent.

Landlords must keep rental units in a habitable condition with all essential services working properly. Tenants should promptly notify Landlords of any necessary repairs. Tenants in New York have specific rights, including the right to withhold rent if repairs are not made in a reasonable timeframe.
New York Eviction Law
If a Tenant violates the Lease Agreement or fails to pay rent, Landlords may initiate eviction proceedings. Before doing this, it’s vital to provide Tenants with the required Notice.
