Sometimes people are charged in federal drug conspiracies when the individual never “had any drugs.” In other words, sometimes a person may live with someone else or they’ve been seen riding in a car when drugs were delivered, and when the person is later indicted and/or arrested on a warrant, no drugs are found. In fact, that person may never have been arrested and caught with any drugs, and so oftentimes it’s puzzling to people and they don’t understand how they can be charged with drug crimes in federal court when they never had any drugs on them.
That comes about through a historical prosecution: in federal drug conspiracy it is very normal for many, many people to be charged with drug trafficking in federal court who were never caught with any drugs. And this is because co-conspirators or cooperating witnesses allege that a person did commit drugs crimes on certain dates. These conspiracies can range over periods of months and/or years, and it’s simply a situation where witnesses are willing to come into court and testify that you’ve participated in it. In federal drug conspiracy, in most instances, many people were never caught with drugs, but they’re charged in that conspiracy and it’s really an extremely serious situation to be in with very wide-ranging consequences.
