The criminal courts can pursue jail time for a wide range of sexual assault cases in Louisiana. At times, the District Attorney in Lafayette, Louisiana may not have enough evidence to prove the assault happened, beyond a reasonable doubt. Sexual assault usually happens in private, and only two people know exactly what happened. This is where the difference in burdens of proof between criminal and civil matters can make a huge difference.
A Civil case in Louisiana involving sexual abuse doesn't carry jail time. However, it does allow monetary damages. While the perpetrator going to jail may help society, monetary damages can pay for the counseling, medical bills, and expenses of the victim of such crimes.
