In this video you will learn about Imprisonment for non-payment of fine when offence punishable with fine only and if a person has no money at all and he is not able to pay the fine so in that case the court impose imprisonment which shall be simple.
The term for which the court directs the offender to be imprisoned in default of payment of fine shall not exceed the following scale that is to say,
1:Not exceeding 2 months when the amount of fine shall not exceed 50 rupees.
2: Not exceeding 4 months when the amount shall not exceed 100 rupees and for any term not exceeding 6 months in any other case.it refers only to cases in which the offence is punishable
with fine only.
When we talk about family case if amount has been decreed in favor of wife and against husband.so if husband has no property and he has no money even to pay the decree amount so in that
case he will be kept in jail.
