Everyone makes mistakes, and sometimes those mistakes can turn into a criminal conviction. But just because you made a mistake and got caught, that doesn't mean you will necessarily have to serve jail time. Many criminal convictions carry little to no jail time. And even for offenses where jail time is required, a skilled and experienced criminal defense attorney may be able to convince the judge that the jail sentence should be converted to probation and electronic monitoring instead of incarceration.
Electronic monitoring is an alternative to serving jail time that usually consists of wearing an ankle bracelet that transmits the GPS location to law enforcement. There are also other versions of electronic monitoring such as a SCRAM anklet which tests for alcohol intake, and a drug patch which tests for drugs.
Judges and prosecutors are much more likely to agree to electronic monitoring in cases where the following 5 situations apply to the convicted criminal:
1.) They do not pose a threat to themselves or public safety.
2.) They did not commit any violent or serious crimes.
3.) They did not commit any offenses carrying prison time.
4.) They live in or near the community where the criminal case is.
And 5.) They agree to adhere to all of the rules of electronic monitoring, such as remaining inside the confines of their home.
It is also important to keep in mind that electronic monitoring is not free, and has serious consequences if it is violated. Electronic monitoring requires a one-time setup fee, and a daily monitoring fee. And anyone who violates the terms of their probation and electronic monitoring will be sent back to jail.
