On October 13, 2022, the IRS & Treasury published a Final Rule to eliminate the “Family Glitch” in the Affordable Care Act. The Rule is titled: “Affordability of Employer Coverage for Family Members of Employees.” The purpose of the rule is to allow Marketplace subsidies to more people purchasing an insurance plan by creating a new test of what is deemed “affordable” family coverage. We explain.
