The Department of Homeland Security announced the designation of Ukraine for Temporary Protected Status (TPS) for 18 months.
To be eligible for TPS, you must be a Ukrainian national or someone without nationality who last resided in the Ukraine, and who are already in the United States.
During a designated period TPS beneficiaries or who are found preliminarily eligible for TPS upon initial review of their cases, are not removable from the United States, can obtain an employment authorization document, and may be granted travel authorization Once the individual is granted TPS, he or she cannot be detained by the Department of Homeland Security on the basis of their immigration status in the United States.
Ukrainians who are eligible for TPS under this designation must have continuously resided in the United States since March 1, 2022. Those who attempt to travel to the United States after March 1, 2022 will not be eligible for TPS.
Ukraine’s 18-month designation will go into effect on the publication date of the upcoming Federal Register notice, which will provide instructions for applying for TPS and an Employment Authorization Document (EAD).
An application for TPS does not affect an application for asylum or any other immigration benefit and vice versa.
