Senate Bill 393 is a new law that makes it easier to get arrest records sealed and destroyed in California. In this video, criminal defense attorney Karthik Krishnan explains.
Traditionally, to get an arrest record sealed in California the arrestee had the burden to prove that he was factually innocent and thus wrongfully arrested. This made the relief especially difficult to obtain.
But a new law passed by the legislature and signed by governor Jerry Brown changes the process. In most cases, this will allow persons arrested but not convicted a shorter and easier route to the sealing and destruction of the arrest records.
