Texas Landlords need to know their rights and responsibilities and should be familiar with Landlord laws in Texas before entering into a Lease Agreement with Tenants. The Lease Agreement is the foundation of the Landlord-Tenant relationship. It’s a legally binding contract that outlines all rules and regulations and protects both parties if issues arise. A standard Lease Agreement is a fixed-term, one-year (12-month) Lease that ends at the end of the Lease period.
Texas Lease Requirements
Beyond basic terms, there are some Texas Lease Requirements that must be included in all Texas Rental Contracts.
- The Lease must state the name and contact information of the person or entity on the deed for the property as well as the name of other authorized agents.
- The Lease must include specific language from the Texas Property Code stating that a Tenant may end a Lease early due to family violence or military deployment or transfer.
- Texas Leases must include language about a Tenant’s rights and remedies if a Landlord fails to make repairs in a reasonable time frame, which is usually 7 days.
- Landlords must include a Flood Disclosure to notify Tenants of any potential flood risks.
- For properties built before 1978, Landlords must provide Tenants with a lead-based paint disclosure and pamphlet.
Lease Agreements for multi-unit properties must include a Parking Rules Addendum or specific language in the Lease about parking.
Texas Landlord-Tenant Laws & Statutes
In addition to Lease requirements, there are some Texas Landlord Laws that Landlords should be familiar with.
- Texas Security Deposit Regulations: There is no limit on the amount of the security deposit as long as it is reasonable. The security deposit must be returned within 30 days of the end of the Tenancy.
- Texas Landlord Entry Laws: Texas does not provide specific regulations about a Landlord’s right of entry, but Landlords should provide Tenants with reasonable notice.
- Texas Late Fee Laws: Late fees must be stated in the Lease Agreement. They can only be imposed when rent is at least two days late and all late fees must be reasonable.
- Renters Insurance in Texas: Tenants may require renters insurance and this is something we always encourage Landlords to do.
- Texas Returned Payment Fee: If a Landlord charges a returned payment fee, it must be included in the Lease Agreement. The fee should be reasonable and should not exceed $30.
- Texas Lease Renewal: Fixed-term Leases generally end at the end of the Lease period unless otherwise stated in the Lease Agreement. Either party may end a month-to-month Lease with 30 days notice.
- Texas Rent Increase Laws: There are no limits on rent increases, but they should be disclosed in the Lease.
- Texas Landlord Repair Laws: Landlords must make a diligent effort to repair problems that affect a Tenant’s health or safety. Repairs should be made within a reasonable time frame, which is usually 7 days.
Texas Landlord & Tenant Rights
Pursuant to Texas Tenant-Landlord laws, Tenants have a right to quiet enjoyment of their rental unit and a right to have any problems repaired that affect their health or safety. Tenant-Landlord laws in Texas further provide that if a Landlord violates these rights, the Tenant may seek to end the Lease or withhold rent.
If a Tenant violates the Lease or fails to pay rent, the Landlord may initiate eviction proceedings. Landlords must adhere to Texas Landlord eviction laws and cannot resort to self-help tactics like changing locks or turning off utilities.
