The Supreme Court has ruled that a legally protected letter can be used as evidence in a £5m claim because it contained improper threats.
The Chief Justice ruled that the “Without Prejudice” letter sent by Verralls law firm amounted to “unambiguous impropriety”, meaning it can be used as evidence by the Claimants in the case.
The case involves online gaming company Mansion Gibraltar and its affiliate Onisac Limited, which is suing their former Chief Executive Officer, Karel Mañasco.
The Claimants, represented by ISOLAS, made an application to the court, alleging the letter was designed to coerce them and their legal representatives into dropping their claim.
