Today, we explore the question of whether a pre-marital home is subject to equitable property division in divorce cases. Using a specific case study from Oklahoma, where the source of funds approach is used, we discuss the factors that may come into play when judges decide how to divide property in divorce cases. Ultimately, it is likely that the value increase of the pre-marital home during the marriage will be subject to equitable division.
