The government is seeking views from the public on whether to bring in a policy prohibiting older adult care homes from using staff, including agency staff and volunteers, who have not received a COVID-19 vaccination, unless they are medically exempt. Vaccine refusal based on ethical or religious objections will not be exempt.
Under the proposals, the care home will be responsible for checking the vaccination status of their staff, and breaches could mean civil or criminal penalties from the CQC (Care Quality Commission).
This will almost certainly give the care home protection from discrimination claims, which has been the concern of care homes to date given the high proportion of people of colour on staff who have a higher rate of vaccine hesitancy.
