"If she had gone to rehab anytime over the last several months when we had been begging her to go to rehab, she could have avoided all of this. I think that's our position and indeed then if I misunderstood and she is ordered to incarceration and then to rehab, we still believe there is a chance if she goes to rehab now, as I originally said. She has a chance to save herself from incarceration. Incarceration is the great fear. It's a fear for her, it's a fear for Michael. Where she belongs is in rehab. We don't believe that incarceration is the place for addicts."

Not knowing what the other one said just shows how the system can fail people and my daughter has been failed in this case and a lot of people will in the future if they don't get it right."

"Right now in general, female inmates that have what are known as non-violent less offenses, misdemeanors, if they are eligible will do in general about twenty five percent of their sentence. However, there is also a state requirement known as, 'good time work time,' which is also calculated into that. However that can be resented if the individual inmate does not play by the rules. A person of such notoriety would probably be kept away from the general population and that's for the safety and security of the jail, the inmates, the staff."

LOHAN'S DAD SPEAKS
A judge sentenced Lindsay Lohan Tuesday to three months in jail and to a rehabilitation program after finding the actress had violated the terms of her probation in a 2007 drug case.
The actress' father and younger sister also burst into tears after the sentence was issued.
Upon leaving the courthouse, the father, Michael Lohan addressed the media. "I will say one thing. This was like coming to Doomsburry today between the program, the prosecutor and the judge. Not knowing what the other one said just shows how the system can fail people and my daughter has been failed in this case and a lot of people will in the future if they don't get it right."
It was unclear how much time Lohan will actually spend in jail. Los Angeles Sheriff's Department spokesman Steve Whitmore said female inmates convicted of non-violent misdemeanors serve about a quarter of their sentence but that can be further reduced by state credits.
Whitmore said Lohan might be released on house arrest, but it would depend on the specifics of Revel's order. What's certain is that Lohan will be in a separate part of the jail at The Century Regional Detention Facility in Lynwood, California.
"A person of such notoriety would probably be kept away from the general population and that's for the safety and security of the jail, the inmates, the staff," said Whitmore.
