PROSTITUTION STINGS
A prostitution sting is when police set up suspected sex workers or customers to get caught soliciting prostitution. The classic scenario is a police officer going undercover as a prostitute or a customer at a bar or a rest stop. If a suspect asks or agrees to trade money for sexual favors, the officer will break cover and arrest the suspect. These undercover officers usually have hidden cameras or bugs to record the encounter to use as evidence in the criminal case.
Prostitution stings are perfectly legal police practices in Nevada as long as the police do not entrap the suspect. Entrapment is when the police threaten or coerce a person into breaking the law who was not predisposed to break the law in the first place. Undercover police merely tricking a suspect into soliciting prostitution does not rise to the level of entrapment.
Entrapment is a defense to prostitution charges. So if the court finds that the police committed entrapment, the criminal case should be dropped.
A first-time offense of soliciting prostitution is a misdemeanor in Nevada, carrying up to six months in jail and/or up to $1,000 in fines. Defendants who were customers – called “johns” - pay an additional $400 criminal fine and $200 civil fine.
