I've bought new 3 Mode SDS Plus 26mm Rotary Hammer Drill Makita HR2610. Unfortunatelly it came as shown in the video above. The head is beating as shown. Here the same drill with some chisel.

I complaint to the seller and requested check and possibly the replace to the new makita. After short period I got the answer from the shop: "below the answer from Makita centre". I've bought it in Poland, so the reply was in Polish. They proposed to repair the drill and definitely concluded: "w przypadku konieczności naprawy (wymiany części ) dokonamy jej , ale nie będziemy wymieniać urządzenia na inne." which translates to: "in case the drill is found being wrong we will repair it, but we will not replace it with the new one". Based on this shop denied my claim and proposed to repair it. I did not want to repair the brand new drill. After some struggle they proposed to return the money, while I still wanted to replace the drill with the new one. Return of the money:
- take time
- I have to pay for shipping anyway (there and back). That is not my fault - why should I pay?
- and I still need a drill. But maybe not makita anymore...
The Polish legislation is based on EU legislation and the governing act says:
"Where the consumer good is inconsistent with the agreement, the buyer may require to have the good restored to the condition stipulated by the agreement, free of charge, i.e. to have it repaired or replaced by a new item".

So I may request replacement with the new one - based on the acting law.
I contacted the makita representative who stated that he will not replace the equipment. He said it is not his problem and I should fix it with the shop since I have bought it from them. I called them: they said: makita denied to replace the equipment so we will not replace it. We follow what Makita says. That is than the end of story.
In that simple loop: the consumer rights were broken, EU legislation was broken. Makita ignorded the customer totally - they want to repair the new equipment.
I looked into makita home page and found their policy. among other things we find there:
- Makita strives to exist in harmony with society (a company that observes laws and regulations, acts ethically and never allows intervention of the anti-social organizations).
- Makita values its customers (a market-driven company).
