CAN I SUE MY BOSS?
Typically when you sustain a work injury in Colorado, you can recover medical expenses, disability benefits, and vocational rehabilitation benefits through your employers’ workers’ compensation insurance program.
But you may be able to sue your employer directly – and possibly recover much more money than through workers’ comp – if any of the following five circumstances apply:
1) Your employer does not carry worker’s compensation insurance.
2) You work for a construction company that did not provide you with adequate safety gear.
3) Your boss intentionally assaulted you.
4) Another co-worker assaulted you and your employer ratified the conduct, or the employer was grossly negligent in hiring that co-worker.
5) The dual capacity exception. This is when your employer has a secondary legal relationship with you that caused your injury. For example if your employer sells a product, and you use that product as a regular consumer would and get injured by that product, you can file a regular lawsuit and not have to go through workers’ comp.
