Christy v. Scott | 55 U.S. 282 (1852)

They say everything is bigger in Texas. But who has the bigger, better claim to Texas property? In this 1852 case, with Texas newly part of the United States, a possessor of land gets booted by an intruder. Now the Court must determine who has the better claim to the property. Will it be the booted possessor who wins his land back? Or will it be the intruder who argues that the possessor’s title was defective?

William Christy was in possession of three tracts of land located in Texas. On June 1st, 1839, William Scott forcefully removed Christy from the land and prevented Christy from reentering.

Christy sued Scott, claiming Christy was wrongfully ejected from the land. In response to Christy’s claims, Scott filed an answer laying out his defenses. Scott argued that Christy lacked title to the land and that another party had a superior claim. However, Scott didn’t provide evidence supporting his own title.

The district court treated Scott’s defenses as raising questions of law and entered judgment for Scott. Christy appealed to the United States Supreme Court.
