Forcible Entry and Detainer or Unlawful Detainer are the legal terms courts use to refer to Eviction Lawsuits.
The Texas Property Code requires a landlord to use the court system to evict a tenant. To begin the process of evicting a tenant, the law requires a landlord to deliver an eviction notice to the tenant being evicted. The eviction notice as well as how it is delivered must strictly adhere to Texas law in order to be valid and enforceable. Eviction notices that fail to meet requirements and proper execution can cause the landlord to lose the eviction case, forcing them to start the process from the beginning.
