GRAND JURIES AND INDICTMENTS
There are two ways that people get charged with crimes in Colorado.
The most common way is by information. This is when prosecutors themselves decide whether there is probable cause to charge the suspect.
The less common way is by indictment. This is when prosecutors present the evidence to a grand jury, and the grand jury decides whether there is probable cause to charge the suspect.
Colorado prosecutors typically reserve grand juries for very serious or high-profile felony cases. Letting a group of regular citizens decide whether to prosecute often lends the charges more credence in the public eye.
A grand jury is totally different from a trial jury. Trial juries decide whether a defendant is guilty beyond a reasonable doubt. In contrast, grand juries simply determine whether there is sufficient evidence to charge a suspect to begin with.
Another difference is that trial juries can hear from both the defense and the prosecution. Meanwhile, grand juries hear only from prosecutors and the witnesses they call.
Finally, trial juries must be unanimous in order to convict a defendant. But in a grand jury, just nine jurors need to agree to indict.
