The I-290B Notice of Appeal or Motion can be used to file a Motion to Reopen or a Motion to Reconsider with USCIS, or to file an appeal with the Administrative Appeal Office (AAO) appealing an adverse decision by USCIS.

A Motion to Reopen is to present new facts, evidence, or a change in law or policy that makes the decision incorrect. A Motion to Reconsider is to point out the decision was based on an incorrect application of the law or policy. An Appeal is a request for the AAO review of the presumed erroneous conclusion of law or fact in USCIS’ decision.
