Today’s Topic: Pitfalls of Social Media in Divorce
Social media has increasingly become one of the biggest topics in any divorce. Recently the Academy of Matrimonial Lawyers mentioned that Facebook comes up in more than 90% of cases. People ranting about their horrible divorce settlements, how awful their soon to be exes are – perhaps smearing his or her significant other – or worse.
There are a couple of things you need to know about this – first and foremost – remember that everything – and I mean everything that you put in writing is a potential trial exhibit – so if you don’t want the judge to see it – don’t post it.
And number two – there are pretty strict laws about destroying potential evidence, so if you think you are going to delete the post, or take down your Facebook page, you may be slapped with sanctions for destroying potential evidence. Not a good thing.
The bottom line – keep your social media usage clean – just picture the judge sitting by you and looking over your shoulder at anything and everything you post. Would you want him or her to see that and make judgments about who you are and what your future is going to look like?
