That's a very good question. Each case is different. Based on my experience in handling these cases since 2004, medical device cases usually take three to four years to resolve. Drug cases usually take longer, anywhere from four to six years. Unfortunately, most of the defendants do not want to enter into settlement negotiations until after all the statute of limitations expire.
In this country, for medical device and drug litigation, there are one to six-year statute of limitations, so defendants do not want to enter into settlement agreements prior to statute of limitations expiring because they fear that that will bring more people into the process. So, many times the defendants drag these cases out until after the four and five-year statute of limitations expire before they want to entertain any type of settlements.
