Blanton v. City of North Las Vegas | 489 U.S. 538 (1989)
How many jury trials would there be a year if every person charged with a D U I could demand a jury trial? We’ll explore the breadth of the Sixth Amendment right to a trial by jury in Blanton versus City of North Las Vegas.
While driving in Nevada, Melvin Blanton and Mark Fraley were each charged with driving while under the influence for the first time in separate incidences. For a first offense, people convicted of a D U I face a maximum of six months of incarceration and a maximum fine of one thousand dollars. They could also have their driver’s license suspended for ninety days.
Blanton and Fraley each demanded a jury trial, but the North Las Vegas, Nevada, Municipal Court denied their requests. They each appealed to the Eighth Judicial District Court. Blanton’s request was denied, but a month later, Fraley’s request was granted. Blanton appealed to the Nevada Supreme Court. The city of North Las Vegas also appealed in Fraley’s case, and the cases were consolidated with others dealing with the same issue. The Nevada Supreme Court held that the federal Constitution doesn’t provide a right to a jury trial when the maximum potential sentence is only six months and the maximum fine is one thousand dollars. The United States Supreme Court granted cert.
