Hi, its Andrew November, your long-term disability attorney. Today we are gonna talk about ERISA. If you’ve been denied disability you’ve probably heard something about ERISA. So, who is ERISA? Well, ERISA is actually a law, it stands for the Employee Retirement Income Security Act. Does it really mean anything? Not really. ERISA is only a law that is maybe 8 pages long. ERISA was passed originally to protect employees who receive benefits from their employer. However, the courts have been able to whittle the law down to something that actually protects employers, so that’s why attorneys like me come in handy to represent you. ERISA only provides a rough outline of what the insurance company and employers must do when they give you your benefits, however the law that controls that controls your case is actually your contract. The contract, also known as the policy or the plan, or even the benefits book at time will explain the procedures and the definitions that control the disability determination, so I don’t worry about ERISA very much, I worry about your contact because that’s our guiding law and as I’ve said in so many other videos, every contract is different, of course there’s things that is same and similar between different contracts, but when I take a case on, one of the very first things I want to see is your denial and your contract, if you don’t have either of those you need to call me immediately so I can help you get it because without seeing your denial or your contract, assuming you haven’t been denied yet, I probably can’t advise you.
