How To Avoid Frozen Bank Accounts is a common question discussed by estate planning attorney Michel J. Young. As an elder law attorney, Michael J. Young of Walnut Creek Elder Law, located in Walnut Creek, California advises clients that they need to address the issue of frozen bank accounts from two perspectives. The first is, what happens when you die, and how do we avoid probate. The second perspective is, what happens if you don't die and you become ill along the way, and you need someone to have access to your bank accounts to help you with your care. It is always best to check with the bank with regard to your goals when you set up various accounts, as this is more of a banking question that it is a legal question. A bank account transferred to a revocable living trust solves both issues. That is, avoiding probate and giving access to the bank account to a loved one. Also, a co-owned account with the bank should solve both issues, but always check with your bank.
