In late 2014 allegations of sexual assaults committed on children by billionaire businessman Sidney Frankel decades ago, surfaced in the media. There are now eight complainants pursuing civil claims for damages against the late Frankel.
They accuse him of sexually abusing them when they were children and wanted him to be prosecuted for the alleged sexual offences. They challenged a law preventing survivors of sexual abuse from laying criminal charges against perpetrators 20 years after the crime is committed.
In June 2017, the South Gauteng High Court ruled in their favour, declaring Section 18 of the Criminal Procedures Act invalid and inconsistent with the Constitution – meaning that children and adults are now allowed to lay charges at any time after sexual offences occur. This was an acknowledgement that sexual offences can have the same effect on victims as rape.
But how will this court ruling play out and will the alleged victims get justice after the accused died in April 2017?
