United States v. Jackson | 405 F. Supp. 938 (1975)
Highly probative evidence is often also highly prejudicial. Are courts required to take an all-or-nothing approach in deciding whether to admit or exclude such evidence? Or can they take a split approach instead? We explore that question in United States versus Jackson.
Andrew Jackson was indicted for assault by a New York state court in July of Nineteen Seventy-One. In August of that year, a New York state bank was robbed. The United States accused Jackson of participating in that robbery. Jackson was ultimately apprehended in Georgia in November. A police officer pulled over Jackson’s car because he believed Jackson and his passengers were acting suspiciously in the vicinity of a recent robbery. Jackson provided a false name and was arrested for driving without a license. Guns were found in the car when he was arrested.
Prior to trial in federal district court on the bank robbery charge, Jackson filed a motion to exclude any evidence that he’d been in Georgia or had used a false name. Jackson argued that the probative value of the evidence was substantially outweighed by unfair prejudice and that it should therefore be excluded pursuant to Federal Rule of Evidence Four Oh Three. The government opposed the motion and argued that Jackson’s flight from New York, coupled with his use of a false name, was probative of his guilt.
