The appellants, Dorothy Konz and Stephen Erikson, were found guilty of involuntary manslaughter for not seeking medical assistance for Reverend Konz during a diabetic crisis that proved fatal. The facts showed that Erikson and Reverend Konz formed a pact to resist the temptation to administer insulin through prayer. Mrs. Konz removed the insulin from the refrigerator and concealed it. The Reverend attempted to obtain insulin, but Erikson blocked his passage, and a struggle ensued. The Reverend canceled his speaking commitment and drove his wife to pick up a nurse friend. While waiting, the Reverend appeared fatigued and complained of an upset stomach. Mrs. Konz and Erikson were found guilty of involuntary manslaughter. The issue on appeal was whether Mrs. Konz had a duty to seek medical attention for her husband. The court found that no such duty was present.
