Attorney Tom Olsen: Hey, Rob. I'm glad that I‘ve got you on the line because I've got a question for you that was presented to me and that is this, is that it came from the landlord, and usually the tenant pays for the utilities, pays for the water, pays for the electric, but this was an unusual situation where the landlord and tenant agree that the water bill would stay in the landlord's name, and as you might imagine, now the tenant's not paying rent, the landlord is asking me, “Hey, Tom, not only am I not getting rent, I'm having to pay the water bill every month, can I just quit paying the water bill?” Can he do that, Rob?
Attorney Rob Solomon: You know it appears that he cannot do that, which is one of the reasons why it's really important that landlords in the first instance have a good lease, and at that lease, never allows the landlords or never permits the utilities to go on the landlord's name, because Florida law does not permit a self-help in an eviction action, and so the landlord is not permitted to turn off the utilities or change the locks, and we now have several cases suggesting that that's even true when it's the utilities that have been left in the landlord's name themselves and so they get stuck between a rock and a hard place, which is, they shouldn't have to be paying the bill, they should be getting repaid for their portion and they're not and yet the law appears, at least according to decided cases of law, not to permit them to turn that offer fail to pay the bill. Then don't do it if you're a landlord.
