The Supreme Court of India has decided that a Muslim woman who has divorced her husband can ask for alimony under Section 125 of the Criminal Procedure Code (CrPC). This decision came in the case of [Mohd Abdul Samad vs State of Telangana and anr]. Justices BV Nagarathna and Augustine George Masih supported a Telangana High Court order for ₹10,000 monthly alimony.
The Court said Section 125 CrPC applies to all women, not just married ones. If a Muslim woman divorces while her alimony case is ongoing, she can also get help from the Muslim Women (Protection of Rights on Marriage) Act, 2019.
This decision confirms the Supreme Court's Shah Bano ruling that Section 125 CrPC applies to Muslim women too, even though the 1986 Act had limits. Stay tuned for updates!
