Grotts v. Zahner | 989 P.2d 415 (1999)
A person injured by someone else’s tortious actions can often claim damages for pain and suffering, even for emotional suffering. But courts have traditionally been reluctant to award damages for emotional suffering to plaintiffs who don’t suffer physical injury. Grotts versus Zahner represents one court’s approach to the issue.
John Colwell died when he and his fiancée, Kellie Grotts, were in a car crash with Gertrude Zahner. At the time Colwell died, he and Grotts were deeply in love and expected to marry in the near future.
Grotts sued Zahner, seeking damages for bystander emotional distress Grotts suffered watching her fiancé die. The trial court dismissed her claim, and Grotts appealed to the Nevada Supreme Court.
