Doggett v. United States | 505 U.S. 647 (1992)
In Shakespeare’s Hamlet, the title character blames his pain on, quote, “the law’s delay,” unquote. Unreasonable delays can cause harm. In fact, under the Sixth Amendment, a criminal defendant has a right to a speedy trial. In Doggett versus United States, we examine a soliloquy on the contours of the Constitution’s Speedy Trial Clause.
On February 22nd, 1980, Marc Doggett was indicted on conspiracy charges. Doggett had traveled to Colombia, so he wasn’t aware of the indictment. Over a year after Doggett’s indictment, a federal agent learned that Doggett was incarcerated in Panama. Unbeknownst to the agent, Doggett was then released and traveled back to Colombia. Over two years after the indictment, Doggett flew to New York and passed through customs undetected. Doggett then settled down in Virginia and lived an ordinary, law-abiding life. During this time, the federal agent still believed that Doggett was in Panama but failed to confirm. When the agent belatedly learned that Doggett had returned to Colombia after his release, the agent stopped tracking Doggett altogether. Nonetheless, in September 1988, over eight years after Doggett’s indictment, officials learned Doggett’s whereabouts and arrested him.
Doggett moved to dismiss the charges based on the Sixth Amendment’s Speedy Trial Clause, but the district court denied the motion. Doggett then appealed to the United States Court of Appeals for the Sixth Circuit, which affirmed the district court’s decision. So, Doggett appealed to the United States Supreme Court, which granted cert.
