This video reviews what to expect when you get to an Expedited Hearing before the WCAB. If you are an injured worker with a California injury, and don’t have an attorney, this video is intended to help provide an overview of workers’ compensation topics so you can better represent yourself.
In workers’ comp cases you can get to a normal trial after a MSC (such as a dispute over the level of PD, or whether a report is correct), or you can get to an Expedited Hearing (or Expedited Trial) on limited issues (and almost always a dispute over temporary disability or medical treatment). The most common scenario is that an injured worker requests an Expedited Hearing because TD isn’t being paid, or treatment isn’t being authorized. Most of the time the disputes are resolved before the hearing. But if they aren’t the judge’s first goal will be to work out an informal resolution of the dispute. This is the fastest and most efficient way to resolve the dispute. If that can’t be achieved, the judge may convert the Expedited Hearing to a MSC and continue the hearing, or the judge may go on the record. If the trial goes on the record, you need to be ready with exhibits and witnesses to move forward with trial at that time. Check out the links below for other videos referenced.
